U.Due south. to make formal extradition request for Huawei CFO

China is demanding the U.Due south. not make the asking

The United States has told the Canadian government that it will issue a formal extradition request for Huawei's chief financial officer Meng Wanzhou.

The Globe and Mail reported on Jan 21st, 2019 that David McNaughton, Canada's administrator to the U.S., said he voiced his concerns to U.South. President Donald Trump'south administration with respect to the dispute, which has caused a string of repercussions for Canada.

One-time Canadian diplomat Michael Kovrig and entrepreneur Michael Spavor were detained soon later on Meng was arrested. They are currently held in custody by Chinese regime.

More recently, Canadian Robert Schellenberg was sentenced to death on Jan 14th, 2019 for drug smuggling. The sentencing has been seen equally retaliation against Canada for Meng'south detainment.

Meng was granted bond but currently faces extradition to the U.Due south., where authorities reportedly said she deceived international banks to funnel transactions between Huawei and Iran. Meng has maintained that Huawei has no connection or interest.

"Nosotros don't similar that information technology is our citizens who are being punished," MacNaughton said to The Globe. "[The Americans] are the ones seeking to have the full force of American law brought against [Ms. Meng] and yet we are the ones who are paying the cost. Our citizens are."

Overnight, China demanded the U.S. drop the asking and blamed Washington for damaging its relationship with Canada.

The Associated Press reported on Jan 22nd, 2019 that Prc's strange ministry spokesperson Hua Chunying said Meng'southward case was an anomaly and that Canada's extradition treaty with the U.South. infringed on the "safety and legitimate rights and interests of Chinese citizens."

Hua demanded that the U.Due south. withdraw the arrest warrant against Meng and "not brand a formal extradition request to the Canadian side."

MacNaughton added he's been pressing China to release the two detained and has learned America is appreciative of Canada for respecting the extradition treaty.

He noted that the deadline for filing a U.S. extradition request is January 30th, 2019, but added that he does non know when the U.S. will formally file a asking.

Later the filing is made, Canada'due south Department of Justice International Assistance Group has 30 days to decide how to proceed. If it gives "authority to continue" it then goes to the Superior Court to determine whether the arrested person is extradited or not.

At the hearing, a judge will determine whether at that place is sufficient evidence that would crave extradition.

It'south important to note that Prime number Government minister Justin Trudeau recently appointed Liberal Member of Parliament David Lametti as the new Justice Minister and Attorney General, who would have the final say on whether or not Meng is extradited. In the past, Lametti has been outspoken about the importance of Canada's relationship with Mainland china.

Meng, during this process, has opportunities to appeal the decision, which could delay the final decision.
